Why these sales are different

An ordinary seller decides when to list. In an estate sale, the trust document or the probate court decides that, along with who signs, how the price gets approved, and who has the right to see every step.

Trust sale · about 4–8 months

  • A private transfer, with no probate court required.
  • The successor trustee sells under the trust's own terms.
  • Faster and quieter. Only the deed ends up in the public record.
  • The hard part is usually the family, not the paperwork: siblings, a stepparent, an heir who isn't ready.

Probate sale · about 9–18 months

  • A court-supervised process when there's no trust.
  • The court appoints the executor, who can't sign until Letters issue.
  • The sale needs court approval, either through an IAEA notice or a confirmation hearing with open overbidding.
  • Higher statutory fees, and the court file is public.

Why an expert matters here

  • Timing is legal, not personal. If you list before Letters issue, or accept an offer the court won't confirm, you can lose months. I build the marketing plan around the hearing dates.
  • The price has to hold up. Beneficiaries, the probate referee and sometimes a judge will all look at the number. A written, comp-by-comp value opinion protects the executor or trustee.
  • The house is rarely market-ready. Decades of belongings, deferred repairs and a vacant property to insure. I bring in the clean-out, repair and security vendors and keep costs in check.
  • Everyone is watching. I send clear, even-handed updates to every heir with a right to them, in English or Mandarin, so the trustee isn't caught in the middle.

Buyers do best with financing fully underwritten, realistic expectations about as-is condition, and an agent who understands the extra steps these transactions can involve. We started working with Will in Jan 2020. Our plan was to buy a new home in Burbank using a bridge loan that Will hooked us up with and then sell our home in Echo Park. Will found us a great home in Burbank & we went in to escrow in March. March 2020. Remember 15 days to slow the spread? Yeah, that March. I was laid off. The bank dropped our loan as I now had no way to pay it. The deal fell through but Will did not give up on us. It took almost a year for us to get back on our feet but Will didn't stop working with us. In June 2021 we closed on the sale of our home. Will deftly handled all the red tape. Common questions

What does a trust sale actually involve?

A trust sale is a private transfer handled by the successor trustee under the terms of the trust, with no probate court required. The trustee signs, the home is marketed and sold, and the proceeds go to the beneficiaries. Most take about four to eight months, compared with nine to eighteen for a California probate.

What's different about a probate sale?

When a property passes through probate court, the personal representative usually sells under the Independent Administration of Estates Act (IAEA), and some sales still require court confirmation and an overbid hearing. I manage those procedural steps alongside the marketing and negotiation so nothing gets missed.

I am an executor and I have never done this before. Where do I start?

Start with a conversation, not a listing. We review the estate documents, confirm your authority, get a value opinion in writing, and decide what — if anything — should be cleaned up before the market sees the home. Most executors are family members, not professionals, and that is entirely normal.
